  DRAW UP MY RENTAL CONTRACT

A contract must be drawn up prior to any rental. The contract enables the owner and tenant to agree on the terms and conditions of the rental. The parties are bound by their signature. 2 copies of this document must be given or sent to the tenant for signature.

The contract must be as precise as possible. It must include the following information:

    INFORMATION

    • Contact details for the owner (or, if applicable, the agent) and the tenant.
    • The address of the rented property and its location.
    • The type of property, its floor area, its general condition, a description of the rooms and a description of the exterior.
    • The property's equipment (e.g. details of furniture, household appliances, etc.).
    • Sleeping capacity.

  +    TERMS AND CONDITIONS

    • Rental dates, departure and arrival times.
    • The amount of the rent, the rate for services (cleaning, linen, etc.) and the payment terms.
    • The amount of tourist tax to be paid.

  The tourist tax has been introduced to encourage the development of tourism. It allows for greater promotion through activities, communication, promotional actions, events and the quality of the welcome, the common aim of which is to attract tourists to our resort. The more the tourist tax revenue increases, in line with the rise in tourist numbers, the more the Tourist Office will be able to expand its activities.

    • Drawing up an inventory of fixtures and fittings on arrival and departure.
    • How to make a booking by paying a deposit and cancellation conditions.

 

   The amount charged is not specifically defined, but it is customary to ask holidaymakers for around 25% of the total rental price.
Unlike a deposit, a down payment does not entitle you to claim the full amount of the rent in the event of cancellation. It is, however, the most popular form of advance payment, as it is the most flexible solution.

    • Payment of a security deposit.

 

   There are no regulations governing the amount of the security deposit. Landlords generally ask for 20% to 30% of the rental price, but this is only customary. You are free to set the price of your security deposit: a fixed amount or a percentage of the rental price.

    • Premises insurance specifying whether or not the tenant must be insured against rental risks.

    • A clause prohibiting or not the presence of animals.
    • Clauses covering interruption and cancellation of the holiday.
